Negligence – Statute of repose – Medical malpractice
Where the defendants in a medical malpractice action were awarded summary judgment under the seven-year statute of repose (G.L.c. 260, §4), the judgment should be reversed because there are genuine issues of material fact in dispute regarding whether the defendants' treatment of the decedent within the seven-year period was negligent.
